This letter is provided in response to your inquiry regarding the operational and regulatory status of Provident Path Academy (providentpathacademy.com). We appreciate the opportunity to clarify our role within the educational ecosystem and to confirm why our platform does not fall under the regulatory jurisdiction or oversight governing nonpublic educational institutions.

1. Legal Definition and Operational Scope

Provident Path Academy is legally registered and operated exclusively as a commercial curriculum and software resource vendor. We are not an accredited school, an unapproved nonpublic school, a learning center, or a child care facility.

Under New Hampshire Code of Administrative Rules Ed 401.01(f), a "school" is defined as an educational institution comprising groupings of students, designated teachers who guide and supervise the learning experience, and an educational program leading to the direct awarding of an institutional diploma or certificate of completion for compulsory attendance purposes.

Provident Path Academy does not satisfy these institutional criteria:

  • No Faculty/Instructional Oversight: We do not employ teachers or instructors to guide, supervise, or evaluate real-time student learning experiences.
  • No Enrollment for Compulsory Attendance: We do not register or enroll students for the purpose of satisfying compulsory attendance mandates under RSA 193:1.
  • No Institutional Credentials: We do not issue state-sanctioned high school diplomas, academic credits, or official institutional transcripts.

2. Shifting of Legal Educational Custody

Our platform functions strictly as a self-paced multimedia library and automated digital record-keeping tool. 100% of the legal responsibility for directing, supervising, and verifying the child's education remains with the parent or legal guardian.

Families utilizing our resources are operating independently under the statutory provisions of New Hampshire RSA 193-A (Home Education) or through state-authorized Education Freedom Accounts (RSA 194-F). In accordance with RSA 193-A:4, the parent-teacher is the sole legal authority responsible for establishing the home education curriculum, maintaining the student's academic portfolio for the statutory minimum of two years, and arranging for mandatory annual academic evaluations.

3. Integration with State Funding Mechanisms (EFA/ESA)

Where applicable, parents may utilize digital wallets or restricted state funding mechanisms (such as the New Hampshire Education Freedom Account program) to purchase access to our materials. In these instances, Provident Path Academy functions strictly as an approved curriculum product vendor. Our inclusion in these programs does not alter our legal status as a consumer vendor, nor does it grant our platform administrative oversight over the student's legal compliance with state truancy or education laws.

Conclusion

Because Provident Path Academy sells educational assets directly to consumer households and does not assume custody, attendance tracking, or instructional oversight of any student, we remain entirely outside the regulatory scope of state nonpublic school frameworks (Ed 400).
